What is the 1-year filing deadline?
Generally, you must apply for asylum within one year of your last arrival in the United States. Failing to do so can bar you from asylum unless you qualify for an exception, such as changed country conditions or extraordinary circumstances.
Can I work while my application is pending?
Yes, but not immediately. You can typically apply for an Employment Authorization Document (EAD) 150 days after your complete asylum application is received by USCIS or the immigration court, provided there are no applicant-caused delays.
What grounds qualify for asylum?
You must demonstrate a well-founded fear of persecution based on at least one of five protected grounds: race, religion, nationality, membership in a particular social group, or political opinion. Economic hardship alone is not sufficient.
Can my family be included?
Yes. You can include your spouse and unmarried children under 21 who are physically present in the U.S. in your application. If granted asylum, you can also petition to bring them to the U.S. later via an I-730 petition.
What happens if my affirmative case is denied?
If the asylum officer does not grant your case and you do not have valid legal status, they will refer your case to an Immigration Judge. This shifts your case from an affirmative process to a defensive one in immigration court.
