Do I have to report to the police first?
No, not before calling us. Unlike the U visa, T visa applications do not require a signed law enforcement certification. Minors under 18 are completely exempt.
I paid a coyote. Does that disqualify me?
No. The 2021 USCIS Policy Manual explicitly forbids blaming victims for taking the dangerous journey. Paying a smuggler voluntarily does not disqualify you.
What if I am already in deportation proceedings?
You can still apply. Asylum seekers in deportation proceedings can request administrative closure while seeking the T visa.
Can my family also be protected?
Yes, and the categories are broad. Spouses and children under 21 always qualify. If you are under 21, parents and siblings under 18 also qualify.
How long does the process take?
Typically 9 to 18 months. But a bona fide determination grants you an immediate work permit while the case is pending.
I don't know if what happened to me is trafficking.
